Agreement to Terms
By downloading, installing, or using the mobile Munch application ("App"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the App.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined below.
Definitions
- Application (or App): Refers to mobile Munch, the software program provided by the Company.
- Company (referred to as "We," "Us," or "Our"): Refers to .Enterface, LLC.
- Device: Any device that can access the Service such as a cellphone or tablet.
- Service: The App and any related services provided by the Company.
- You: The individual accessing or using the App.
Use of the App
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Use the App in any way that violates applicable local, national, or international laws
- Attempt to gain unauthorized access to any part of the App or its servers
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
- Use automated scripts to collect information from or interact with the App
User Accounts
To access certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to terminate accounts that violate these Terms.
Munch Rewards Program
Participation in the Munch Rewards program is subject to the following:
- Rewards points are earned by checking in at participating food truck vendors through the App
- Points have no cash value and cannot be transferred or sold
- We reserve the right to modify, suspend, or terminate the Munch Rewards program at any time
- Fraudulent check-ins or misuse of the rewards system may result in account suspension
Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of .Enterface, LLC. You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.
Third-Party Links and Services
The App may contain links to third-party websites or services (e.g., food truck vendor pages, Google Play, App Store). We are not responsible for the content or practices of any third-party sites. We encourage you to review their terms and privacy policies.
Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, .Enterface, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
Governing Law
These Terms shall be governed by the laws of the State of Kansas, without regard to its conflict of law provisions.
